1. Acceptance of Terms

By accessing or using onsited ("the Service"), operated by onsited ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

onsited is a website builder platform that generates professional websites for local businesses. The Service includes:

• Automated website generation from Google Places business data
• AI-powered content creation for service descriptions, FAQs, and business copy
• Website hosting on onsited subdomains and optional custom domains
• A dashboard for managing and editing your website

3. Accounts

To purchase a website, you must create an account with a valid email address and password. You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorized access to your account.

You must be at least 18 years old to create an account and use the Service. By creating an account, you represent that you are at least 18 years of age.

4. Acceptable Use

You agree not to use the Service to:

• Create websites for illegal, fraudulent, or deceptive purposes
• Impersonate a business you do not own or have authorization to represent
• Distribute malware, spam, or other harmful content
• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Attempt to gain unauthorized access to the Service or its systems

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

5. Intellectual Property

Your content: You retain ownership of any original content you provide (business name, descriptions, images you upload). By using the Service, you grant us a license to host, display, and distribute this content as part of your generated website.

Generated content: Content generated by our AI systems (service descriptions, FAQs, branding suggestions) is provided for your use as part of the Service. You receive a license to use this generated content on your onsited website and for your business purposes.

Our property: The Service itself, including its design, code, templates, and underlying technology, remains the property of onsited and is protected by intellectual property laws.

6. Generated Websites

Websites generated by the Service use data from Google Places and AI-generated content. While we strive for accuracy, we do not guarantee that all generated content will be error-free. You are responsible for reviewing and editing your website content before and after publishing.

We do not fabricate contact information, email addresses, social media handles, or URLs that are not present in your Google Places data. Any such information displayed on your website must be provided or verified by you.

7. Payment & Billing

Paid plans are billed as one-time purchases processed through Stripe. Prices are displayed at the time of purchase on our pricing page.

Starter plan: Includes website hosting on an onsited subdomain, dashboard access, and website editing capabilities.

Professional plan: Includes everything in Starter plus a custom domain (standard domains valued at $20/year or less are included).

Refund policy: If you are unsatisfied with your purchase, you may request a refund within 14 days of payment by contacting us at support@onsited.pro. Refunds are issued at our discretion. Custom domain registration fees are non-refundable once the domain has been provisioned, as this involves third-party costs.

8. Domain Names

Custom domains purchased through the Service are registered on your behalf. Domain registration is subject to availability and third-party registrar terms. We are not responsible for domain disputes or trademark conflicts arising from your domain selection.

Subdomains (e.g., yourbusiness.onsited.pro) are provided as part of the Service. We reserve the right to reclaim subdomains that are inactive, infringing, or violate these terms.

9. SMS Notifications Program

Program name: onsited.pro Quote Notifications

Description: A transactional SMS program available to Professional plan customers. When a homeowner submits a quote request through your generated website, we send a short text message to the mobile number you have verified, alerting you to the new lead and providing a link to view it in your dashboard.

Eligibility and opt-in: The program is available only to active Professional plan subscribers in the United States and Canada. To enroll, you must (a) enter your mobile phone number in the SMS Settings section of your account dashboard, (b) verify ownership of that number by entering a one-time code we send via Twilio, and (c) explicitly accept the on-screen TCPA disclosure shown when you toggle SMS notifications on. Consent records (timestamp, IP address, disclosure version) are retained for compliance.

Message frequency: Message frequency varies and depends entirely on the number of quote requests submitted to your website. We send one SMS per quote request.

Message and data rates: Message and data rates may apply. Charges from your wireless carrier are your responsibility. Carriers are not liable for delayed or undelivered messages.

Opt-out: Reply STOP to any message at any time to immediately unsubscribe from the program. You may also disable SMS notifications by toggling them off in your dashboard at onsited.pro/dashboard. After opting out you will receive a single confirmation message and no further messages will be sent unless you re-enroll.

Help: Reply HELP to any message for assistance, or contact us at support@onsited.pro.

Supported carriers: AT&T, Verizon Wireless, T-Mobile, Sprint, Boost, U.S. Cellular, MetroPCS, and most other U.S. and Canadian carriers. Carriers are not liable for delayed or undelivered messages.

Privacy: Your phone number and SMS opt-in records are handled in accordance with our Privacy Policy. We do not share phone numbers with third parties for marketing purposes.

10. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or modifications that temporarily affect availability. We are not liable for any downtime or service interruptions.

11. Termination

You may close your account at any time by contacting us. We may terminate or suspend your account if you violate these terms or for any other reason at our discretion, with reasonable notice where possible.

Upon termination, your website will be taken offline. We may retain certain data as required by law or for legitimate business purposes.

12. Limitation of Liability

To the maximum extent permitted by law, onsited and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, arising from your use of the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

14. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of material changes by posting the updated terms on this page with a new "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated terms.

15. Governing Law

These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which onsited operates, without regard to conflict of law principles.
